Terms & Conditions

THESE TERMS AND CONDITIONS CONTAIN A BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER. PLEASE READ CAREFULLY.

1. The Rental Agreement

These Rental Terms and Conditions, the Additional Policies annexed hereto as Exhibit A, the Rental Contract, and the Rental Receipt together constitute the "Rental Agreement" between yourself and Joseph Auto World LLC ("JAW").

2. Your Rental

You rent from JAW the car described on the Rental Contract, which rental is solely a transfer of possession, and not of ownership. You are not our agent for any purpose.

3. Meaning of "Car"

The word "car" means the vehicle rented to you and its replacement, including tires, tools, keys, key fobs, remote devices, and all other parts and documents.

4. Who May Drive the Car

Only an authorized driver may drive the car. An authorized driver is the renter and any additional driver listed on the Rental Contract. Every driver must be at least 21 years old and have a valid driver's license.

5. Return of the Car

You must return the car to our office or the location specified on the Rental Contract in the same condition as received. Late fees apply:

  • Less than 1 hour: $20.
  • 1-2 hours: Half of the daily rental charge.
  • More than 2 hours: $20 plus full additional daily rental charge.
  • If lateness causes cancellation of another reservation: Up to $100 fee.

6. Rental Charges

You will pay for the number of miles you drive and the period of time you rent the car. The minimum charge is one day (24 hours).

7. Taxes, Surcharges and Fees

You will pay all applicable taxes, governmental surcharges, and airport related fees. This includes administrative fees for processing tickets or tolls.

8. Security Deposit

A security deposit of $500 is required. For renters under 25, this deposit is required for every reservation. For 25+, it is required for the first rental. Refunds are processed within 72 hours of return.

9. Refueling

If you do not return the car with the same amount of fuel as when received, you will be charged $12 for each 1/8 of a tank missing.

10. Cleaning and Smoking

We maintain a non-smoking fleet. A fee of up to $350 applies for intensive cleaning due to smoking, pet hair, or bodily fluids.

11. Prohibited Uses

Violation of this section voids all liability protection and optional services. Prohibited uses include driving under influence, towing, racing, off-road use, or illegal acts.

12. Accident Reporting

You must promptly report any accident or theft to JAW and the police. You must complete an accident report within 24 hours.

13. Responsibility for Damage or Loss

Regardless of fault, you are responsible for all damage to or loss of the car, including loss of use and administrative fees, unless you purchase LDW.

14. Loss Damage Waiver (LDW)

LDW is not insurance. It is an optional service that waives your financial responsibility for damage to the car, subject to exclusions.

15. Liability Protection

Anyone driving the car as permitted by this Agreement is protected against liability for causing bodily injury or property damage to others up to the minimum financial responsibility limits required by law.

16. Connected Car Data & Telematics

The car may be equipped with technology that collects data on location, speed, fuel level, and performance. We may use this data for repossession or service monitoring.

17. Repossession

We may repossess the car without notice if it is used in violation of the law or this Agreement, or if it appears to be abandoned.

18. Fines, Expenses, Costs and Administrative Fees

You are responsible for all tickets, tolls, and parking fines. A 10% administrative fee applies to the processing of each violation.

19. Personal Property

We are not responsible for loss of or damage to any personal property in or on the car or in our service vehicles.

20. Personal Data

You are responsible for deleting any personal data (contacts, navigation) from the car’s memory before returning it.

21. Arbitration and Class Action Waiver

Any dispute arising out of this Agreement shall be resolved by binding arbitration under the American Arbitration Association rules.

22. Error in Charges

Charges on your Rental Receipt are not final. We may correct any errors and bill you for the correct amounts.

23. Cancellation Policy

Cancellations within 24 hours of pickup incur a fee equal to half a day (for trips under 2 days) or a full day (for longer trips).

24. Tolls and EZ-Pass

You are responsible for all tolls. If you use our transponder, you will be billed for the toll amount plus our administrative fees.

25. Roadside Assistance

Emergency roadside assistance is available but charges apply for service calls not related to mechanical failure.
